This mandamus action was brought in the Superior Court by certain banks and loan companies (lenders) to compel the Honorable Norman A. Barron, Chief Magistrate of the Justice of the Peace Courts to rescind a policy directive he issued regarding the calculation of wages subject to garnishment under Delaware's 85% statutory exemption. This involves an interpretation of 10 Del.C. § 4913(a) & (c), which provides: (a) Eighty-five percent of the amount of the wages for labor or service of any person residing within the State shall be exempt from mesne attachment process and execution attachment process under the laws of this State; but such limitation shall be inapplicable to process issued for the collection of a fine or costs or taxes due and owing the State.
