On March 4, 1959, at approximately 9:30 a. m., the plaintiff Mrs. Wilma Turk, and her son, John Neal Turk (hereinafter referred to as Mrs. Turk and John), entered the H. C. Prange Company department store (hereinafter referred to as Prange), located in the city of Sheboygan. John was only five years and ten months old at the time. After shopping in the store for a while, Mrs. Turk and her son used the escalator to go from the second floor down to the main floor. They had used the escalator on many previous occasions. John preceded his mother on the escalator. At the base of the escalator, Johns galosh was caught in the escalator. The boy started screaming. Mrs. Turk grabbed him around the waist and tried to pull his galosh out but was unable to do so. She was still on the moving escalator at this time. As a result she lost her balance and fell, landing on the steel stair of the escalator, fracturing her wrist. Mrs. Turk and her husband brought suit against the defendant Prange, who in turn interpleaded the defendant Otis Elevator Company (hereinafter referred to as Otis) based upon the alleged negligence of Otis in furnishing and maintaining the escalator.
